Yes. The applicant should design or hire a professional designer to create a unique trademark for its business goods or services.
Which form can a trademark be?
A trademark is a visible sign in the form of letters, numerals, words, pictures and images, including three-dimensional images or their combinations, presented in one or several given colors.
If a trademark is a combined design of letters, numerals, words, pictures and images, it would be better for protecting the applicant’s IP rights. However, registering for a combined trademark frequently costs higher than registering for a singular trademark.
Should the applicant register for a trademark in black and white or colorful?
It depends on the applicant’s uses and budgets, but the applicant should register for a trademark both in black and white and colorful.
Registering in black and white can grant the protection of the applicant’s IP rights on all lines of products bearing this trademark. However, it cannot protect the creativity of the applicant in using colorful combinations to be eye-catching for the customers because its rival might use identical or similar color combinations to confuse consumers.
Where can the applicant do a trademark lookup before registration?
The applicant can do or hire the IP office or law firm to do a trademark lookup before registration. But finding an experienced expert or agency to do such a lookup will be the best solution to save time and money.
