Registering the intellectual property rights for the company logo

Article 13 of Decree No. 22/2018/ND-CP Regulations on visual works and applied artworks are as follows:

• Visual works specified in Point g, Clause 1, Article 14 of the Intellectual Property Law are works represented by lines, colors, shapes, and layouts such as paintings, graphics, sculptures, etc. installation art, and similar forms of expression. Particularly for the graphic type, it may appear in the 50th edition, numbered and signed by the author.
• Works of applied art specified in Point g, Clause 1, Article 14 of the Intellectual Property Law are works represented by lines, colors, shapes, and layouts with useful features, which can be associated with a useful object, produced manually or industrially such as graphic design (expression of logos, product identification systems, and packaging), fashion design, product styling, interior design, decoration).

Simultaneously, in Clause 1, Article 14 of the Intellectual Property Law, types of works are protected by copyright as follows:

Protected literary, artistic, and scientific works include:

• Literary and scientific works, textbooks, coursebooks, and other works expressed in writing or other characters
• Lectures, speeches, and other speeches;
• Journalistic works ;
• Musical works;
• Theatrical works
• Cinematographic works and works created by similar methods (hereinafter referred to as cinematographic works);
• Visual works and applied artworks;
• Photographic works;
• Architectural works;
• Maps, diagrams, maps, and drawings related to topography, and scientific works;
• Literary and folk artworks;
• Computer program, data collection.

Therefore, company logos are considered visual works, applied works. Copyright is protected by Point g, Clause 1, Article 14 of the Intellectual Property Law
